1. Scope

These Terms and Conditions (T&Cs) apply to all business relationships between Mestre Interior Design GmbH (hereinafter referred to as "we", "us" or "Mestre Interior Design") and our clients (hereinafter referred to as "client" or "customer") in connection with interior architecture, spatial design and interior design services.

Deviating terms and conditions provided by the client are only valid if explicitly agreed to in writing and confirmed by us.

2. Services Offered

Our service portfolio includes:

  • Interior architecture and design

  • Space planning and conceptual development

  • Consulting, visualisations (mood boards, 3D renderings, sketches)

  • Material and colour schemes

  • Furniture, lighting and decoration planning

  • Shopping advice and project support

The exact scope of services is defined in the individually agreed offer or project contract.

3. Offers and Contract Conclusion

Our offers are non-binding and subject to change, unless explicitly stated otherwise. A contract is considered concluded upon:

  • Written acceptance of the offer by the client, or

  • Mutual signing of a written project contract, or

  • Order confirmation by both parties via email

4. Service Delivery and Client Responsibilities

We commit to delivering the agreed services professionally and on time. The client agrees to provide all necessary information, documentation, decisions and input in a timely manner.

Delays due to missing input from the client release us from agreed timelines and may result in additional costs.

5. Pricing and Payment Terms

All prices are quoted in Swiss Francs (CHF), excluding VAT (if applicable), unless otherwise agreed in writing.

Payment terms:

  • 50% deposit upon project start

  • 100% advance payment for Call a Designer service

  • Interim payment instalments as agreed (for larger projects)

  • Final payment upon completion of services

Invoices are payable within 14 days of the invoice date, without deduction. In case of late payment, we reserve the right to charge reminder fees and interest on arrears.

6. Third-Party Services

We reserve the right to involve third parties (e.g. craftsmen, suppliers, visualisation specialists) to carry out specific services. Unless otherwise agreed, such third-party services are organised in the name and on behalf of the client.

7. Ownership and Usage Rights

All drafts, concepts, plans, drawings, visualisations and presentations developed by us remain the intellectual property of Mestre Interior Design GmbH.

The client receives a simple right of use for the materials created during the project – exclusively for use within the agreed scope. Any distribution, reproduction or commercial use requires our prior written consent.

8. Liability

We are only liable for damages caused by intent or gross negligence. We accept no liability for defects in third-party services (e.g. from craftsmen or suppliers), unless such third parties were directly commissioned by us.

We accept no liability for consequential damages or loss of profit.

9. Withdrawal and Termination

Both parties have the right to withdraw from the contract within 14 days of signing, without providing reasons. Services already rendered and bindingly commissioned third-party services will be invoiced proportionally.

After the 14-day period, the client may terminate the contract. In this case:

  • Services already rendered and agreed third-party services are payable in full.

  • An additional flat fee of 10% of the agreed project total will be charged as compensation for project preparation, unless higher advance efforts can be proven.

Termination must be made in writing.

10. Confidentiality

Both parties agree to treat all non-public information obtained in the course of the collaboration as strictly confidential.

11. Use of Project Documentation for Portfolio Purposes

Mestre Interior Design GmbH reserves the right to use photos, visualisations and plans created during the project for its own reference purposes (e.g. portfolio, website, social media, presentations), provided that no personal data or identifiable individuals are shown.

The client may opt out of this use by notifying us in writing before the start of the project.

12. Final Provisions

Should any provision of these T&Cs be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. An effective provision that best approximates the economic purpose of the invalid clause shall replace it.

Swiss law applies exclusively. The place of jurisdiction is Zofingen (AG), Switzerland.
